Cell Phone Records<\/strong><\/h3>\n

One of the most reliable ways to show that a driver was texting at the time of your accident is to petition to have their cell phone records used as evidence in your case. To do this, working with an attorney is crucial. You will need them to subpoena the records and make the argument that the person was, in fact, texting when the accident took place.<\/p>\n

Witnesses to the Accident<\/strong><\/h3>\n

Anyone who saw the accident happen<\/a>, including other drivers or pedestrians, will hopefully stop and provide statements to the police about what they saw. Someone may have noticed that the other driver was texting and will contribute this information to police. In many cases, witnesses must be subpoenaed to testify about what they saw.
